ACORN at 441 Elmwood – Fighting Back Against Bad Faith Evictions

Today, 17 tenants and Hamilton ACORN members gathered outside 441 Elmwood Avenue, a house that’s sat empty for nearly two years after a tenant was wrongfully evicted using a bad faith N12 notice.

The former tenant spoke powerfully about their experience, and how the Landlord and Tenant Board (LTB) failed to protect them. 

Members shared ACORN’s provincial platform demanding urgent LTB reform highlighting one of our key proposals:

The burden should not be on tenants to prove bad faith,  landlords must be required to prove good faith.

ACORN members spoke with neighbours, handed out flyers, and plastered the neighbourhood to raise awareness about our platform and demands to the landlord.

A flyer and a letter were taped to the door of still vacant 441 Elmwood with clear demands to the landlord:

  • Stop using loopholes in the LTB to evict tenants in bad faith.
  • Put the home back into use as rental housing. 
  • End bad faith evictions for good.
